Judge orders residents and city to come to agreement on partially collapsed building in Buffalo, New York

Buffalo, New York —Judge Justice Christopher Burns of the New York State Supreme Court has ordered a halt to an emergency demolition on a 19th century stable and livery on 428-430 Jersey Street in Buffalo, New York that partially collapsed on Wednesday June 11, initially causing at least 15 homes to be evacuated. At least two homes remain evacuated.

Burns orders that both the city and the group Save The Livery (www.savethelivery.com) have to come to an agreement on what to do with the building, and try to work out ways of saving at least some portions if it including the facade, side walls and a lift tower. Save The Livery is comprised of concerned area residents who have grown to love the building’s historic and unique character. On June 14, they won a temporary restraining order to stop demolition. The court ruled that the city was only allowed to remove material in immediate danger to residents and pedestrians, but stated that the demolition could only be performed with “hand tools.” The court also ordered that any rubble which had fallen into neighboring yards when the building collapsed, to be removed.

“It is in the interest of the city to have a safe environment–but also important to maintain a sense of historical preservation,” stated Burns in his ruling. Burns has given the sides until tomorrow (Friday June 20) to come to an agreement and has ordered both parties to return to court at 9:30 a.m. (eastern time) “sharp.” Activists of Save The Livery urge supporters of the stable to “fill the courtroom” to show “continued and ongoing support.” The hearing is scheduled to take place at 25 Delaware Avenue in the Supreme Court building, 3rd Floor, trial part 19.

Currently the building is owned by Bob Freudenheim who has several building violations against him because of the buildings poor condition. He has received at least five violations in three months and residents who live near the building state that Freudenheim should be “100% responsible” for his actions. Many are afraid that if the building is demolished, Freudenheim’s charges of neglect will be abolished.

On June 17, developer and CEO of Savarino Companies, Sam Savarino was at the site of the stable, discussing the building with residents and preservationists. In 2006, Savarino proposed and planned The Elmwood Village Hotel, a ‘botique’ hotel on the Southeast corner of Elmwood and Forest Avenues. The project was later withdrawn after residents filed a lawsuit against Savarino and the city. Wikinews extensively covered the story, and contacted Savarino for his professional opinion on the building.

“[I would] love to see it preserved. I was there to see if there was anything we could do to help, to see if anything can be salvaged. I just want to see the right thing happen, and so does the city,” stated Savarino to Wikinews who added that he was allowed inside the building for a brief period.

“The side walls are beyond repair. The roof has rotted and it could come down at any time,” added Savarino who also said that the building “below the second floor appears to be stable.” He also states that the back wall of the building, which borders several homes, appears to be intact.

“Eliminating the back wall could be a problem for the neighbors. It is not unreasonable to leave at least 12 feet” of the back wall standing, added Savarino.

Savarino did not say if he was interested in buying the property, but did state, “I am sure there are a couple of people interested” in buying the property. On Thursday, Buffalo News reported that a “businessman” might be interested in purchasing the property, though Wikinews is not able to independently confirm the report. Savarino says that with the property still slated for emergency demolition, a potential buyer could face tax fees of nearly US$300,000.

Freudenheim gave the city permission to demolish the building on Thursday June 12 during an emergency Preservation Board meeting, because he would not be “rehabilitating the building anytime soon.” Freudenheim, along with his wife Nina, were part-owners of the Hotel Lenox at 140 North Street in Buffalo and were advocates to stop the Elmwood Village Hotel. They also financially supported a lawsuit in an attempt to stop the hotel from being built. Though it is not known exactly how long Freudenheim has owned the stable, Wikinews has learned that he was the owner while fighting to stop the hotel from being built. Residents say that he has been the owner for at least 22 years.

The building was first owned by a company called White Bros. and was used as a stable for a farm which once covered the land around the building for several blocks. The Buffalo Fire Department believes the building was built around 1814, while the city property database states it was built in 1870. Servants and workers of the farm were housed inside resident quarters situated at the rear of the building on what is now Summer Street, but are now cottages where area residents currently reside. Some date as far back as 1829.

At about 1950, the stable was converted into an automobile body shop and gasoline station.A property record search showed that in 1950 at least four fuel storage tanks were installed on the property. Two are listed as 550 square feet while the other two are 2,000 square feet. All of the tanks are designated as a TK4, which New York State says is used for “below ground horizontal bulk fuel storage.” The cost of installing a tank of that nature according to the state, at that time, included the tank itself, “excavation and backfill,” but did not include “the piping, ballast, or hold-down slab orring.” It is not known if the tanks are still on the property, but residents are concerned the city was not taking the precautions to find out.

World Trade Organization allows Antigua to ignore US$21 million of US copyright per year

Arbitrators at the World Trade Organization (WTO) have granted the Caribbean country of Antigua and Barbuda a special dispensation to ignore United States copyright law.

In their report, the WTO panel stated that Antigua possessed “no effective trade sanctions against the USA” and agreed to allow the country to ignore up to US$21 million worth of US copyrights a year. While this amount falls significantly short of the US$3.4 billion per year dispensation that Antigua was seeking, it is far higher than the US$500,000 per year allocation that US negotiators were pushing for.

The ruling comes at the end of a five year legal contest between Antigua and the USA regarding the USA’s blocking of offshore online gambling sites. Because many of these sites were located in Antigua, the Antiguan government filed a complaint with the WTO saying that the US prohibition constituted unlawful restriction of trade. When the WTO agreed, Antigua pressed for US$3.4 billion in punitive damages. They asked to have this penalty assessed as permission to copy US intellectual property, since there was no trade embargo that Antigua could impose on the US to collect the amount for itself. The panel agreed that Antigua had no way to collect punitive damages through trade sanctions. However, they lowered the amount of damages to US$21 million per year.

Cloned cattle’s milk and meat seem safe, according to new study

A National Academy of Sciences report (.pdf) last year said that while the milk and meat from cloned animals would not likely make anyone sick, more research should be performed. Now, a new US-Japan study published in the April 11 online issue of the Proceedings of the National Academy of Sciences says that milk and meat from cloned cattle does indeed appear to meet industry standards and appears to be safe for human consumption.

As BBC News reports, the scientists, led by Professor Jerry Yang from the University of Connecticut, compared the produce from two beef and four dairy clones, all derived from a single Holstein dairy cow and a single Japanese black bull, with the produce from normal animals of similar age and breed.

The meat was analysed against more than 100 physiological, tissue and cellular components, while the milk was analysed for protein, fat and other variables. No significant differences between the produce of cloned and normal cattle were found. Higher levels of fat and fatty acids were found in the cloned cow meat, but they still fell within beef industry standards.

While the study showed the cloned produce to be within the range approved for human consumption, the scientists stressed that the research was still in its early stages. Their findings, they said, provide “guidelines” for further research with larger numbers of clones from different genetic backgrounds.

Cloning livestock may one day increase yields by copying those animals that are especially productive and especially resistant to disease.

“The milking production levels in the US are three to four times higher than levels in China; maybe even five times or more compared to cows in India and some other countries,” Professor Jerry Yang told BBC News. “Therefore cloning could offer technology for duplicating superior farm animals. However, all the products from these cloned animals must be safe for human consumption. …and it is a major issue for scientists to provide a scientific basis for the data and information to address this question.”

As USA Today reports, there is currently no law governing the sale of meat or milk from the estimated 1,000 to 2,000 cloned farm animals in the USA. But since 2003, the US Food and Drug Administration (FDA) has asked producers to voluntarily keep the meat and milk of these animals, and that of their offspring, out of the food supply.

Wired News reports that companies like ViaGen and Cyagra, which offer livestock-cloning services, have also been waiting for several years for a final say from the FDA.

“For the United States agricultural industry, (cloning) can reduce the number of cows necessary for milking,” said Jerry Yang “They can have a pleasant environment and produce even more milk.” He also said that cloning cattle from the United States, where genetic breeding is more advanced, could save developing countries 50 years of breeding.

The idea of cloning animals for human consumption is not without its critics. First, there are the welfare concerns, as most cloned animals do not make it to term before being born, and many of those that do are born deformed or prone to illness. The Humane Society of the United States has asked for a ban on milk and meat from clones for just this reason. Second, there is still the concern that healthy clones may have subtle defects that could make their food products unsafe to eat.

As the Washington Post reports, some critics are asking why it is necessary to clone cows that produce huge amounts of milk when surpluses, rather than shortages, are the main problem facing the U.S. dairy industry today.

R&B singer D’Angelo sentenced on cocaine charge

Tuesday, September 13, 2005Rhythm and blues artist D’Angelo was able to walk out of Judge William R. Shelton’s Chesterfield County courthouse in Virginia on Monday after being given a 3-year suspended sentence for possession of cocaine.

D’Angelo, also known as Michael Eugene Archer, 31, pleaded no contest to the charge. The appearance in court, by the now heavier-set Archer who was once known for his trim physique, was the result of a traffic stop for driving 61 mph in a 45 zone. In connection with the incident, he was also charged with driving while intoxicated (DUI), and possession of marijuana and cocaine.

Archer avoided jail time for all charges in the incident. In April, his driving privileges were suspended for one year, and he received a 90-day suspended sentence, plus a $250 fine, for the DUI conviction. On the marijuana charge, he received a $50 fine and 10-day suspended sentence.

At the time of his arrest, traces of cocaine were found on a folded dollar bill.

D’Angelo received Grammy awards for “Best Male R&B Vocal Performance” and”Best R&B Album” in 2001.

Marussia F1 test driver Maria de Villota seriously injured in testing accident

The Marussia F1 team’s test driver, Spaniard María de Villota, was taken to hospital by air ambulance today after a collision in testing at Duxford Aerodrome.

At the end of her first installation run, the car she was driving had a low-speed collision with the loading ramp of the team’s support truck. According to BBC Cambridgeshire presenter Chris Mann, the car “suddenly accelerated” into the rear of the vehicle. The Marussia team released a statement an hour and a half after the accident, stating that she had been transferred to hospital, and a further statement would be issued once her condition had been assessed.

A spokesman for the East of England ambulance service, Gary Sanderson, said de Villota had “[…] sustained life-threatening injuries and following treatment at the scene by paramedics, she has been taken to Addenbrooke’s Hospital for further care.” According to witnesses, she was motionless for about fifteen minutes as medical teams attended to her, but did move her hands before being taken away from the test track. Medical charity Magpas, whose volunteer paramedics attended the accident, reported she had sustained injuries to her head and face, and was in a ‘stable condition’ when she reached the hospital.

Marussia reported her as conscious later in the afternoon: “Since Maria’s arrival at the hospital at approximately 10.45am this morning, she has been receiving the best medical attention possible at the hospital, which is the region’s major trauma centre. Maria is conscious and medical assessments are ongoing. The team will await the outcome of these assessments before providing further comment. The team’s first priority at this time is Maria and her family.”

De Villota was announced as Marussia’s test driver in March, having prior experience driving for Alan Docking Racing in Superleague Formula in Spain.

When it comes to party games making an incorrect choice can affect the guests enjoyment of the whole event. Know The Games : As a guest there is nothing worse than seeing a host struggle with a party game. Lack of preparation becomes very obvious. Save yourself the embarrassment and practice the games before the party. Props: Make sure you have all the material and props you require to play the games Timing: Plan the introduction of party games for the appropriate time.
